1. Introduction

These Terms of Service ("Terms") govern your use of QuietGrowth's services, including our Google review automation, smart booking system, and AI chatbot products (collectively, the "Services"). By using our Services, you agree to be bound by these Terms.

QuietGrowth ("we", "us", or "our") reserves the right to update these Terms at any time. We will notify you of material changes via email or through our dashboard.

2. Service Description

QuietGrowth provides the following services to South African businesses:

  • Google Review Automation: Automated email-based review request system that sends personalised requests to your customers on your behalf.
  • Smart Booking System: An online booking widget and management dashboard for scheduling appointments and services.
  • AI Chatbot: An AI-powered chatbot widget that can be embedded on your website to answer customer questions using information you provide.

3. Acceptable Use

You agree not to use our Services to:

  • Send review requests to people who have not been genuine customers of your business
  • Generate fake, misleading, or incentivised reviews
  • Send spam or unsolicited communications
  • Violate any applicable laws, including the Consumer Protection Act and POPIA
  • Upload harmful, offensive, or illegal content to the chatbot
  • Attempt to reverse-engineer, copy, or resell our Services
  • Use the Services in any way that could damage our reputation or infrastructure

We reserve the right to suspend or terminate your account if you violate these terms.

4. Payment Terms

  • All prices are listed in South African Rand (ZAR) and include VAT where applicable.
  • Subscriptions are billed monthly via Paystack.
  • Payment is due at the start of each billing cycle.
  • If payment fails, we will attempt to charge your payment method again. After 7 days of failed payment, your account may be suspended.
  • Prices may change with 30 days' written notice.

5. Cancellation Policy

You may cancel your subscription at any time from your dashboard or by contacting us at hello@quietgrowth.to. Upon cancellation:

  • Your service will remain active until the end of your current billing period.
  • No refunds are provided for partial months or unused portions of your subscription.
  • Your data will be retained for 30 days after cancellation, after which it will be deleted.
  • You may request immediate data deletion at any time.

6. Intellectual Property

All content, design, code, and branding associated with QuietGrowth are our intellectual property. You retain ownership of all content you upload to our platform (business descriptions, FAQs, customer data). By using our Services, you grant us a limited licence to use your content solely for the purpose of providing the Services.

7. Limitation of Liability

To the maximum extent permitted by South African law, QuietGrowth shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of our Services.

Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the total fees paid by you in the three (3) months preceding the claim.

We do not guarantee that the Services will result in any specific number of reviews, bookings, or customer interactions.

8. Disclaimer

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or completely secure. Google review policies are controlled by Google and may change at any time.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
